I purchased a bag of dried appricot slices from the local walmart in town. As o was walking out i grabbed a handful and started chewing them without any hesatitation only to become very ill and unstable. I put my nose to the bag and a almost passed out from the smell of what i have just digested. I turn around and went back into the walmart to voice my concern. The on duty manager asked his employees to go examine the product to see if it was an isolated case or not.

i witnessed one employee bring afew identacle bags to the front and open them and smell them, upon first smell the employee had the same reaction i did, almost passed out. Thr brand is "Joes tasty Travels" and the package reads downright healthy foods, Toronto, ON. Healthy eh? almost killed me. They asked me if i had wanted an ambulance as they called other walmarts around to remove the product imediatly from shelfs. I said no, i will drive my self to the hospital.

After about 45 mins i started breaking into a sweat and feeling these cutting pains in my stomach, I'm 52 years old and called my son to say good bye as i thought i was not going to make it. As i waited in emergency I was more convinced i ate a product that had been contaminated and my weak imume system wont be able to fight it off.

after missing the next 4 days of work i turned the corned but still wasnt able to keep any liquids down. I never even received a call from these corprate monsters to see how i was doing or for them to show any concern. All they wanted was to replace the product. At the time i was far to unstable to think logicall so didnt pursue any conversation but later thought to myself they only wanted the contaminated product back probibly to avoid any law suit for my experiences. Any how, i dont have the money to pursue a law suit but i did keep the product and handed half of it to the doctor who took my blood and than told me to call health and safety Canada.

they did show up took my story and some of the contaminated product and left to interview walmart, who coinsadently calls me and offers an appology for the products they sell and even went on to ask i was pursuing legal action.

I at the time said no because i dont have money for lawyer fees never mind a corp giant like walmart who will keep this in court for years and make me go broke.

Long story short, please people be aware of the dried fruits on sale at your local walmarts, ahd it been an elderly person im sure this would have been fatal and im not sure if im in the clear yet as health and safety has yet to contact me with the results.

I have all records of the incident with walmart documented by their staff as well as health canada. I think i deserve at least some sort of gift card but its usless to me as i would never step foot on their property again

Your suggestion to find a lawyer who will take the case on for a contingency fee does not apply in Ontario. In Ontario lawyers cannot be hired on a contingency basis as it is against the law. Lawyers in Ontario must charge an hourly fee.

Wal-mart did everything they could and had know way of knowing the product was bad. Recalls start somewhere. It's too late now but if you had taken their help and filed an accident report, I'm sure your medical bills would have been covered.

You mentioned you felt you were entitled to a gift card. A gift card. And this gift card would help you how? And how much is this gift card supposed to be for? That ruined your whole story. Now I can't believe anything you said. You refused an ambulance but you felt you had been poisoned. You said goodbye to your son because you didn't think you'd make it due to your "weakened immune system". Again, as I've said before to many ripoff posters, PLEASE read and reread your posts before submitting them. While it may sound to you like a plausible story others may see through it rather quickly. Like me. Sorry, no ripoff. Case dismissed. Oh, and by the way, please do post all reports from the health organization you spoke of as well as what type of poisoning you had ASAP.

They did everything right. I mean really out of their way right. You refused medical help. You refused money back or an exchange. This is lawsuit hunting. Also lawsuits that you will win don't cost money up front because the lawyer knows you will win. Never even heard of a real lawsuit where anyone paid up front. Now go get a lawyer and sue the people who made the product. Of course you won't get anything other then your medical bills paid for. Which you will get if you just call them and file a complaint.

I am not a fan of Wal Mart or lawsuits done willy nilly, but I do like justice. You say you don't have money for a lawyer. Find a lawyer who does consumer issues, and they usually will take the case on a contingency fee, meaning, the lawyer does not get paid unless you prevail. However, there will be some upfront costs such as the court filing fee and perhaps a mediation fee. Ask about these. You may have cause of action against both Wal Mart and the packer of the product. I like to think, but I can't be sure, that a lawyer can evaluate your case better than responders to your complaint. Really, I do like to think that is true.

Unless the package had a sell by date that had expired. Then Walmart is responsible for leaving it out for sale. They are responsible for removing expired food from the shelves. I have found items still on Walmart shelves that had expired by about a week and I was searching for newer ones - found one that was 3-4 months past the expiration date still on the shelf!

Let me get this right.... 1. They pull the product not only form their shelves, but they start calling other stores to do the same. 2. They offer to get you an ambulance but you decline. (Now here is where this becomes your fault). So how is Walmart supposed to know of your situation after you leave? I know they are a giant corporation, but as of this posting, I don't think that they have any satellites in orbit to track customers after they leave. I could be wrong, after all it is Walmart, and I distrust them. 3. Once they are made aware of your situation, they call to apologize. So where is the rip off? Look I am no advocate of Walmart, and I will never shop there. But I just don't see how this would entitle you to a gift card? You refused their offer of help. Its like declining to be taken to the hospital after being involved in an auto collision, only to later claim that you now have back and neck problems. You made a choice, for whatever reason, and you had to shoulder the consequences too.

It's the company that made the apricots. They clearly didn't process them correctly and had a batch that was containmented. Any store could have received the shipment, it just happened to be Wal-Mart in this case. You should be upset with the company that made them, Joe's Tasty Travels, not Wal-Mart.
