Your suggestion to find a lawyer who will take the case on for a contingency fee does not apply in Ontario. In Ontario lawyers cannot be hired on a contingency basis as it is against the law. Lawyers in Ontario must charge an hourly fee.

Wal-mart did everything they could and had know way of knowing the product was bad. Recalls start somewhere. It's too late now but if you had taken their help and filed an accident report, I'm sure your medical bills would have been covered.

You mentioned you felt you were entitled to a gift card. A gift card. And this gift card would help you how? And how much is this gift card supposed to be for? That ruined your whole story. Now I can't believe anything you said. You refused an ambulance but you felt you had been poisoned. You said goodbye to your son because you didn't think you'd make it due to your "weakened immune system". Again, as I've said before to many ripoff posters, PLEASE read and reread your posts before submitting them. While it may sound to you like a plausible story others may see through it rather quickly. Like me. Sorry, no ripoff. Case dismissed. Oh, and by the way, please do post all reports from the health organization you spoke of as well as what type of poisoning you had ASAP.

They did everything right. I mean really out of their way right. You refused medical help. You refused money back or an exchange. This is lawsuit hunting. Also lawsuits that you will win don't cost money up front because the lawyer knows you will win. Never even heard of a real lawsuit where anyone paid up front. Now go get a lawyer and sue the people who made the product. Of course you won't get anything other then your medical bills paid for. Which you will get if you just call them and file a complaint.

I am not a fan of Wal Mart or lawsuits done willy nilly, but I do like justice. You say you don't have money for a lawyer. Find a lawyer who does consumer issues, and they usually will take the case on a contingency fee, meaning, the lawyer does not get paid unless you prevail. However, there will be some upfront costs such as the court filing fee and perhaps a mediation fee. Ask about these. You may have cause of action against both Wal Mart and the packer of the product. I like to think, but I can't be sure, that a lawyer can evaluate your case better than responders to your complaint. Really, I do like to think that is true.

Unless the package had a sell by date that had expired. Then Walmart is responsible for leaving it out for sale. They are responsible for removing expired food from the shelves. I have found items still on Walmart shelves that had expired by about a week and I was searching for newer ones - found one that was 3-4 months past the expiration date still on the shelf!

Let me get this right.... 1. They pull the product not only form their shelves, but they start calling other stores to do the same. 2. They offer to get you an ambulance but you decline. (Now here is where this becomes your fault). So how is Walmart supposed to know of your situation after you leave? I know they are a giant corporation, but as of this posting, I don't think that they have any satellites in orbit to track customers after they leave. I could be wrong, after all it is Walmart, and I distrust them. 3. Once they are made aware of your situation, they call to apologize. So where is the rip off? Look I am no advocate of Walmart, and I will never shop there. But I just don't see how this would entitle you to a gift card? You refused their offer of help. Its like declining to be taken to the hospital after being involved in an auto collision, only to later claim that you now have back and neck problems. You made a choice, for whatever reason, and you had to shoulder the consequences too.

It's the company that made the apricots. They clearly didn't process them correctly and had a batch that was containmented. Any store could have received the shipment, it just happened to be Wal-Mart in this case. You should be upset with the company that made them, Joe's Tasty Travels, not Wal-Mart.
