We are writing this letter for assistance with the problems we have been facing with Wells Fargo Home Mortgage. We contacted Wells Fargo Home Mortgage on July 1, 2009 for assistance with our monthly mortgage payment. My wife had just lost her job of six years when her real estate brokerage was forced to shut down, and we were facing financial hardship. We had forced to become a one income family, and our monthly medical expenses had drastically increased due to a recent Autism Spectrum Disorder diagnosis for our son. Although my wife had been granted Unemployment payments, her income was less then half of her normal salary, and we were struggling just to make ends meet. I am a police officer for a local county. I often could depend on additional income from secondary employment. However, with the struggling economy many of those secondary employment opportunities became few and far between. We were suddenly faced with the possibility of losing our home, that we had worked so hard to have. Over the past ten years we have been homeowners, we had NEVER been late or missed ANY payments. We had been doing some research on the programs available to homeowners that President Obama had developed, and decided to reach out for assistance. That is when we contacted our mortgage lender, Wells Fargo, and inquired about any available programs. It has always been our best intentions to work towards fixing the challenges we were faced with, and getting back on our feet as soon as possible. We simply didn't want to lose our home without trying everything possible.

We spoke with a Wells Fargo Representative who explained there was indeed programs that would help us with our sudden hardship. We were given instructions on starting the process of obtaining a loan modification. We were told this process could take 90-120 days, but most likely 45-60 days. We were told as long as we were in this program our credit would not be effected. We prepared all the necessary paperwork and documentation and faxed it to Wells Fargo. Shortly after submitting necessary documents we received a letter congratulating us on a reduction of monthly mortgage payments from just over $1700 to $862.41 for the next three months. When those three months had expired we contacted Wells Fargo and were told to keep making those same payments until our loan modification had been granted. This was just the beginning of our nightmare. After faxing documents, mailing letters, submitting income verifications, eleven months later, we just received notification that we do not qualify for a loan modification. We were told investor guidelines was the reason. Apparently, they believe our debt to income ration is too high. Isn't that ironic? That is exactly why we were asking for assistance in the first place! Wells Fargo has informed us we must pay $11,914.61 in back mortgage payments by 6/15/2010, or face foreclosure. If we had $12,000 sitting in an account, why would we have asked for assistance in the first place? How can Wells Fargo do this? We are now in worse shape then we were back in July 2009! Had we known that this sort of baiting and switching could happen, we would have sold our house a year ago! Not only do we now face foreclosure, our credit is destroyed, something that Wells Fargo said would be prevented by being in this program. We were in a bad place, and faced with providing medical necessities for our Autistic son, or a roof over his head! Wells Fargo did the exact opposite of what they said they would do. They took advantage of hard working homeowners who were trying everything in their power to make ends meet! According to our research online, Wells Fargo is taking advantage of millions of people. How can a bank that was given millions of dollars to help homeowners in our situation not be responsible for their actions? They are promising solutions and brainwashing you the entire time.



We, along with thousands of others, believe Wells Fargo is violating the TILA, Fair Debt and Collections Act, RICO, along with many other fraudulent activities. We need assistance in making sure Wells Fargo does not get away with causing so many families to lose their homes, while they sit back and collect their bonuses.



We have filed the same complaint with Wells Fargo, The Better Business Bureau, The Comptroller of The Currency, The Federal Reserve, and even forwarded a copy to President Obama himself. We need to make sure Wells Fargo doesn't continue taking advantage of people who simply were strong enough at one of their weakest moments and asked for the only help they knew.

May  I suggest that you contact Federal Trade Commission and refer them to this website.  You can also report them to Better Business Bureau and also other blogs like Yahoo Answers.

Give Wells Fargo loads of Coverage as a warning that Customers will just pull their money out of their institution of Fraud and Deception...Let's hope they Never get a taxpayer based bailout either! Make sure to Contact your Congressional Representatives and Senators and refer them to this website as well, so they can see how many reports there are about them.  This just scratches the surface.  Good luck to you!

Wells Fargo has done the same thing to me. I was on the loan modification plan for 4 months due to my wife losing her job. After 4 months of an increased rate, I was refied at rate around 400 more then what my payment was originally. 2 months after that I was on the new payment schedule, I was let go from work also.
I applied for another refi since my income from unemployment is less then 1/3rd of what I used to make. I filled out all of their required forms and received an acceptance letter with no dollar amount I was to be paying . In that packet they sent they sent me the standard request to look at previous years federal income tax statements. So I sent that in and then heard nothing from them at all for a little more then 4 months. I finally was able to talk to someone today and they had no update on anything and requested I send the same information I had originally sent. I really don't understand how Wells Fargo can get away with playing games like they are not only once but twice now. If I could anything different, it would be not to use Wells Fargo in the first place.
Does anyone have any suggestions of what I can do?

I am SO sorry for all of you who have responded/rebutted!!  This company is causing so many problems (other than just financial) for so many good, hard-working families!  It seems as if you cannot catch a break with them.  I'm just going to say this, because it's all true.  If they feel they are being a victim of libel/slander, let them sue me.  They lie, cheat, break/breach THEIR OWN contracts, and steal money from people all under the guise of "working with you."  Their employees are, to say the least, ill trained.  To say the truth, stupid.  I spoke with an allegedly "high-ranking" employee (probably manager of the call center - whoohoo), who told me that even if we do file a Ch. 13 BK, WF does NOT have to agree to let you stay in your home.  They are under NO obligation to let you keep it!!  I was shocked.  I also spoke with an acquaintance who had her home taken from a different bank, and she's told me they didn't even give her the mandatory 90 days' notice, only 30.  You are correct when you say this whole thing is politically based, it is.  The woman mentioned above who had the foreclosure told me the banks get reimbursed every penny from the government if they foreclose, sell and fall short of the amount owed on the house.  So, basically, the government is telling them to go ahead and take as many as you can, we'll help you out!  So much for helping the "little people" in America.  I am doing what I can to find an attorney, and putting my big mouth to good use.  As I stated in one blog, I talked to my zoning dept., and they told me I could put a LARGE sign in my yard, as long as it didn't contain swear words or block traffic.  You'd better believe that's what I'm going to do - and do letters to the editor of every paper, call radio stations, I'll even write to Oprah!  I won't be silent about these theives!  Good luck to all - and yes, the Bahamas are looking better every day!

I have submitted a very similar story months ago and Im sure you have read others, I believe its a scam, we made 8 trial payments not the 3 promised to re-do our loan, on our 9th Wells would not accept our payment, why, becuase they said we no longer qualified. We are over two years into this ! There is no doubt they will take our home now, we have again for about the 4-5 time- refiled for modification. I would love to be part of a class action suit I dont think there is an attoney out there that will touch this, its politicaly motivated ..... Our life like yours is on hold, we cant file bankruptcy or the modifaction cant be done, we have to live in the home, it cant be for sale or rent. Two years ago when we applied we were one payment behind and pre-qualified, had been out of work for one year and used all our savings, no wtwo years later my husband and I are back to work, 1/3 the income but back to work and slowly climbing, now they say we dont qualify , we did two years ago when it all went down !!!  Wells has now even returned $ to me with no letter no explanation I have gotten two checks in the mail one for a strange amount but close to two of the trial payments and one for the exact amount of the trial payment. Good Luck to you.

Our story is almost identical except that we have dealt with them twice with the same situation.  First time over 2 years ago.  My husband was laid-off and we contacted Wells and we were told the same thing as you, make these 3 payments (which were higher than our normal monthly payment, go figure)we'll do a loan mod.  We got the run around for months and then RI housing helped facilitate. While all this went on my DH found a job and they gave us the modification (with major fees tacked on).
We were fine for awhile and then my DH was laid-off from his job again.  This time because of the economy (RI I believe was the 2nd highest unemployment rate in the country) it was for a year and obviously we fell behind in all our bills.  We called W.F. again and were told to make the 3 payments and they'd work with us.  We scraped together the payments and filled out the paperwork and waited & waited for several months.  In the meantime we were forced to claim bankruptcy. Which apparently stops the loan Mod paperwork and now we have to file again.  My DH is working again so hopefully they'll work with us but we cannot do it if they tack on another 25,000 and we'll have to find a place to rent with 3 children, one of which just received the DX of High Functioning Autism and is all set in his mind about the school he is going to next year (we had to visit and acclimate him to his new environment) and if we have to move somewhere else it will cause anxiety.
WF is a horrible company.  My parents tried to work with them on their home of 35 yrs and WF refused because of their "investors" .  Well my parents handed them the keys and WF sold the house after a yr of being empty for over $130,000 less than what my parents owed, to a development company who in turn sold it  last month for a profit.  These banks do not care, they are in the business of money.  President Obama bailed them out but it certainly didn't trickle down.   We are going to be nation of homeless and the banks are becoming landowners.  I'm seriously thinking of moving to another country.  Good luck to you.

I have already written two rebuttals just today, to scenarios much like yours and ours.  We have been give the runaround by Wells Fargo for MONTHS, being assured that "everything is fine - no worries."  Well, right up until we were served with foreclosure papers we were dumb enough to believe them.

I've already posted the two earlier rebuttals, but suffice it to say, we need to get an attorney and a class action against Wells Fargo.  We offered to pay the FULL amount of our home loan if they would modify it so we could start fresh, having missed a couple payments.  Their advice?  Short sell it for $60,000.00 (a THIRD of the amount owing).  Want to know why they are in financial trouble?  Seriously?  They are offered over $180,000.00 for an almost 50 year old house which only books for near $60,000.00 anyway, and they won't take it?

We did hire an attorney and now have to file bankruptcy.  We know some of your pain.  Our 4-year old grandson lives with us (with his mother), and he is autistic.  What should I have told him and my daughter, no you can't move in because we can't afford the mortgage payment if you do?  I don't think so.

They are idiots (no libel or slander here, I have proof, bring it on).  They need to be held accountable for their actions, and their charter needs to be revoked.  They are cheating anyone and everyone they can, and laughing at us.  Feel free to respond, I am serious about the class action lawsuit!!
