After being solicited to apply for a "loan modification, Wells Fargo claimed on multiple occasions to have never received my paperwork, despite the fact that I have the fax confirmation sheets, and a different WF rep would tell me that they had been received. They told me twice NOT to make my mortgage payments because I would be disqualified from the process. On the 2nd day of the month after my mortgage was due, they filed foreclosure on my home. They stated that I would need over $12000.00 to reinstate my mortgage which was about $7200.00 in payments an an estimated $5000.00 in estimated legal fees. Even if my modification is approved, I was told that I am responsible for any accrued legal fees accrued by Wells Fargo.

I finally went to a local branch office and had the branch manager listen to my call to their loss mitigation/modification personnel. He was horrified to hear their denials of my faxes, and that I shouldn't make my payments. When he spoke up, miraculously, my faxed info was entirely accounted for and we were told that there would be no problem with my approvals. I remain dubious, since at no point in 3 months was I notified that my rate would climb by over a full point. How is this allowed?
