Well, like so many others I have been reading about, we got three months behind on our mortgage. We recieved a notice from Wells Fargo stating we were facing forclosure and that unless we got caught up our house would be sold on November 20, 2009. Or to avoid that we had to pay around $6,700.00 for payments and all other associated costs.
We contacted Wells Fargo to make the full payment, no questions asked. At this point the representitive from WF told us that WF could re-structure our and move those three payments to back. She sent us all of the required forms and had us provide all our financial documentation (tax returns, leave and earning statments, break down of our monthly expences, and hardship letter). At this time she told us not to make any more payments until The "LOAN MODIFICATION" was complete. August and September went by, during which they lost and we resent our paperwork twice. We called two or three times a week trying to find out the status of our mod, each time being assured that all was fine and that they were just very busy.
Late in september we started to recieve the forclosure notices again.. In a complete panic and now going on six months behind on our payments, we contacted WF and again they reassured us that all was well and we should should everything settled within the week..
Sure enough they contacted us about a week later and said everything was approved and we just needed to re-write our hardship / offer letter and send them a check for $7,000.00. No problem we did as they asked the following day. We were then told that our first payment of the new plan was due on December 1st. COOl..RIGHT
Not... On the 13th of November they returned our check, which we recieved on the 17th, with a note that said we were rejected. Then on the 20th they sold our house..
Totally freaking out now.. we spent three or four days trying to reach someone to find out what hell just happened.. To no avail.. So not knowing what to do we went back to the forclosure notes and saw that we had thirty days from the date of sale to vacate.. So I have spent the last 30 days trying to sort, pack and move 14 years of accumulated life..
To some it up today we recieved a letter from a lawyer (soaking wet in the mail box), I'm sure it was supposed to be served, That stated "Freddie Mac" now owned our home.. They however are offering "Relocation Assistance", $3,000 if I'm out in thirty days or $2,000 if I'm out in sixty days.. Big delema...
I have decided to take the sixty day option.. but I'm not cleaning anything up, in fact I'm leaving a huge mess.. They can shove thier money!
I would like to know is there any legal recourse for what they have done or does anyone have any good advice?

I know ecxactly what you mean by nightmare!! the same exact situation happend to me but with bank of america.they sold the house to fannie mae and never return the money they asked us to "STOP THE AUCTION ON THE HOUSE" and one of the persons that comment on your case is so "RIGHT" "HOPE" might be getting a big chunk out of this huge foreclosure epidemic.hope didnt help us at all!!
this banks are hindering,misleading,abusing,violating hopeless people besides stilling from them without any body acting or doing anything about it! !!!!

Contact your local news stations and newspapers to expose Wells Fargo.
This guy exposed GMAC and won! His situation was very similar to yours. In short, after bad publicity and pressure from a local news station, GMAC bought him a new homein cashfor mishandling his foreclosure.

I have been trying to find out if there are any law suits or any other legal remidies.. I mean the bottom line is that Wells Fargo stole $250,000 from us and who knows how many others there are and how many billions they are stealing

My experience with Wells Fargo is similar, Wells Fargo is only interested in making as much money from the HAMP program application that acts as a conduit to the bank's own loan modification money making program which is additional cost to homeowners and good money for the banks above your mortgage payment.
Hope Now, the volunteers to help you obtain a loan modification program is nothing but an arm of the banks. They are helping the banks make money and not helping people stay in their house. Refer to CSPAN with the administrator Faith Schwartz. Watch the hearings and her interview with CSPAN. She might be college professor but I think she is on the payroll of the banks.
There are a number of Congress People who might find your story of interest.
Here is CSPAN video of the Congressional hearing and the failure of HAMP and the increase in homes being foreclosed on, one million in foreclosure today compared to 230,000 in April 2007.
Congressman Conyers is one, Cohen, Franks, Smith, Johnson, Delahunt, and Scott. These Congress people are on the CSAPN program during a hearing on the HAMP program. You may want to share your story with them. Go to CSPAN.org and watch the hearing with Faith Schwartz.

The HAMP program is supposed to help people stay in their homes but the banks are disqualifying applicants to the HAMP after long delays with no Congressional Oversight. Supposedly HOPE NOW is an advocate for the homeowner. This is a lie. They are advocates for the banks to make money for them and the lenders. Wells Fargo just paid back their $25 Billion and are resuming huge bonuses to their employees.
The only way this can be fixed is with Congress oversight, don't expect the banks, the lenders, or HOPE NOW to do it. I think Congress knows the HAMP is a bust becaue the FOX (Banks, Lenders, and HOPE NOW) is in charge of the chicken coop (access to the HAMP program). Evidently, it is business as usual, if you have any assets, you will go through those assets, retirement and other savings before the banks will modify anything.
Like a good intentions of Congress with a program like HAMP, the banks are in charge of it and will find a way to NOT implement it and make money in the process.
Banks caused this problem with people losing their homes, don't expect them to fix it.
They are making to much money to do otherwise.
