Complaint Review: William Utnehmer - Sonoma, Los Angeles, Venice, San Francisco California

I respect a persons right to freedom of speech and appreciate the power of the internet for research, but what I dont respect is when someone anonymously uses a medium like this to spread damaging falsehoods.

These false allegations came about because this individual's investment in a residential development project with CW Development Partners was lost in 2008 when the real estate market collapsed. We had eight real estate projects in the development pipeline encumbered with conventional short term development loans, many of which could not be sold or financed and went into default. We spent 2008 and 2009 averting foreclosures and completing structured settlements with lenders and investors to maximize recovery. Those efforts provided this investor false hope in what was ultimately an insurmountable worldwide financial crisis. Nevertheless, he personally blames me solely for the loss of his investment. He was unqualified to participate in the risks of real estate investment.

In connection with those projects and the accompanying notes secured by deeds of trusts, lenders in those counties filed multiple notices of default (i.e., multiple court filings). These legal filings were conventional real estate related actions and did not assert fraud or any other misconduct. While I was out of the country (and without notice to me), this individual filed a complaint for fraud and obtained an ex parte judgment in my absence. Subsequently, the court found no fraud, no false statement, no willful conversion and determined the allegations were without merit.

I have never committed fraud, been involved with a shady contract or fraudulent lease, misguided victims, stole anyone's business idea, or discussed company needs with a real estate developer that investigated me. The allegations on this website are simply not true. The complaints are disguised to be purportedly filed by multiple individuals and an investigation firm, but do not disclose their identity because of the fictitious nature of the claims.  These are malicious and defamatory claims anonymously posted by a disgruntled and vindictive malcontent.

Inasmuch as I have attempted to take the high road and ignore this belligerent and heretical internet stalking, it is nevertheless detrimental to my business reputation and more importantly, unsettling for the personal sanctity of my family. We are pursuing legal action for defamation of character, slander, false light, intentional interference with prospective economic relations and business disparagement. Although we expect to prevail in this action, this site is not liable for its content and refuses to remove these illegal posts because defamation and libel are protected free speech under to the federal Communications Decency Act.

A legitimate background investigation will confirm a profile of a successful businessman as well as a substantial civic and philanthropic contributor to my community. Notably, a national award from Counselors of Real Estate, pro bono development of a Rudolf Steiner Waldorf School, AIA award for construction design and ecology, work with Freie Universitat Berlin in Germany, lecturing at the Department of Economics at Hochschule Anhalt in Germany, selection as US liaison for Green Cross International (Mikhail Gorbachev's organization), mentorship at the Business School at Pepperdine University, incubation of a public benefit corporation for applying capitalist tools to socially conscious ventures, etc.

Consider the integrity of this website and the vindictive and unreasonable conduct demonstrated by the author of these posts. There is a fundamental value of our society to avoid condemning an innocent man. As the rebuttal by an anonymous Utnehmer supporter, I will start by quoting them in defending William Utnehmer. 

Minimal investigation will confirm a rich profile of an active, successful businessman as well as a substantial civic and philanthropic contributor to his community.

Our firm was asked to screen Mr. Utnehmer in 2011
as he and my client (real estate developer) had discussed company needs, and so my client in moving forward asked that we develop an idea of Utnehmer's reputation and public record history.

This is a brief overview and why we felt William Utnehmer is purposely deceptive in both nature and practice, engaged in multiple civil and business cases, judgements personally & business related, with growing negative social opinion.  I would recommend his long term friend and partner John Kwan, who he destroyed financially well before Bill himself.             

Socially William/Bill Utnehmer seems to have a style of saying just enough to engage an investor in contractual agreements, however they feel from that point they were provided little information on progress, misleading answers, and deceptive contractual wording.  

Bill Utnehmer used investment funds foolishly both travelling overseas, and maintaining his image to "appear" to be what in fact he was not, yet when the market dropped he was savvy enough to arrange subleasing below market value yet left multiple individuals financially to suffer.

I presented him with a business opportunity back in 09 as I assumed that he was a reputable developer. He ended up stealing the ideaand forming a company with an identical business model. I strongly doubt that he was successful (given that he knew nothing on the industry). It is a shame to see that he has acted similarly with other investors / entrepreneurs

Professionally we found nothing supporting the self promoted claims made by William Utnehmer and his multiple projects, companies and no proof as ever being a successful attorney or developer.

His award at the Waldorf School was presented, however his termination from that position leaves us of the opinion that they too were not impressed.

Considering the amount of court related actions against him we found debtor action to be motivated by his deceptive nature and practice, which Utnehmer explained as strictly a market situation. It was determined Bill Utnehmer fraudulently intended to use banking relationships to extend and cover his failure in trying to profit on others wealth.

The story of Utnehmer buying Rustling Ridge Vineyard in Sonoma was investigated, and found to be false.  William & Marie Utnehmer rented there a short time, and have since moved again. 

Owner of Rustling Ridge wasn't available to comment on this rumor, but operates a quality business and no evidence of intent to sell was found.

Although Bill Utnehmer has a presentation and style suggesting he has experience and a successful track record, nothing of substance was found to support this.
