I am writing on behalf of my brother who placed an order with this company recently for a pair of size 6 Air Force Ones Lux Edition (white), order #3666. My brother is in Iraq at war and bought them for me as a Christmas present through their website which has no phone number.

The pair of shoes sent are NOT a size six but a size NINE. Now obviously, there is no way that he could respond to the company within the unreasonable three day deadline if he is in Iraq. In addition, there is a big difference between a size six and a size nine so there is no way that it is merely an issue of the shoe not fitting.

Prior to making the purchase, he specifically e-mailed the company requesting information as to whether the size six advertised on your site would be equal to a size seven and a half in ladies' sizes, to which he received a reply confirming that they were indeed the same size.

I do not feel it just for him to be stuck with a pair of sneakers that he did not order due to inproper labeling by the company. If there was no other alternative, I requested instructions on how to return the product to them at the company's expense and receive an immediate credit to his account.

The response I received were the following 2 emails:

Dear ---,

We are sorry to hear of your disappointment with our product and/or service. Unfortunately, this case has already been closed, and accordingly we are unable

to proceed any further. We must follow strict regulations due to the number of transactions we process daily.

Additionally, although you claime that he received confirmation on the sizing equivalence, please note that this is impossible, as per company policies, we are unable to confirm any details relating to sizing with customers. Again, we regret to inform you that we can no longer do anything for you.

As per the customer user agreements that was agreed to and accepted at the time of the purchase, we must receive communication regarding the problem within three business days from receipt, regardless of the situation.

"...Customers are required to notify customer services within three business days after receiving their products if they wish to make an exchange...."

Your case has already been closed, and will not be processed any further. This has also been expressed to Global Clear, our payments processor. Although we

apologize for your disappointment, we have to follow guidelines due to the number of transactions processed daily.
