Complaint Description:
Yelp.com culled my business "Magic Of The Nightingale" from some public
resource i.e. the Yellow Pages, Google etc.  A disgruntled customer gave us
a libelous review in April 2011. In the summer of 2011, Yelp put the
review at the TOP of all the search engines online showing only Magic Of
The Nightingale, one star (which means "the worst")and the text of the
libelous review.

As a result, this illegal practice is ruining my business.
Customers who search for Magic Of The Nightingale see first and only the
libelous review and move on to a different vendor. This has recently
been exacerbated by "Smart Phones" and "Blackberries" where the customer's only contact
with my business is the Yelp review.

Yelp is Judge, Jury and Hangman in the blink of a mobile phone app.

Many other customers have posted positive reviews about my business and
Yelp systematically hides them, leaving only the libelous review with
one star at the top of the page.

I have asked them to remove the libelous review, asked them time and
again to remove my company, asked them how I can remove my company from
their Data Base. Yet they insist that in the "name of honesty" they can
do anything they want to my company and hundreds of thousands of
companies Nationwide.

This is neither honest nor fair. What Yelp doing is both immoral and unethical.
Yelp's sabotage and abuse is ruining my business and the business of
hundreds of thousands of businesses Nationwide.  Their practices are in violation of The US Constitution: First Amendment Free Speech and Yelp is violating my civil rights.

PS: I have repeatedly called/written to them to remove any and all of my
ads/my companies from their Data Base. I want no part of them or their
site. Surely that is my civil right.

 ADDITIONAL DETAILS:
Case is being handled by another organization: Federal Trade Commission. I am writing to every branch of government.  Please do the same in your state, The ACLU and your State's Attorney.
Any law firm out there that is willing to help or file a class action lawsuit, please contact me.

My Desired Resolution:
Withdraw the libelous review. Remove any and all of my ads/my companies from
their Data Base. Allow any company nationwide to withdraw their
advertising from Yelp. I want no part of them or their site. Surely that is my right and the right of every American. Every other online marketing advertiser: Google, Yahoo etc. allows you to withdraw.

I too actually took a look at your review.  Quite frankly I wouldn't actually be too worried about seeing a single bad review on a single site.

But as a possible customer I would be more concerned about your response to that review that you posted on Yelp on 12/24.

As for the filtered results.

I would also wonder why if you have been in business as long as you said why do all of your positive reviews come within a couple of days of each other.

I would also wonder why a person who in their Yelp profile states that "Yelp is neither honest nor fair" would even bother to post a review of any company?

I would also wonder why a person from NY would be using your services when you are in Chicago?

that you refer to on Yelp, it would seem (if true), that you are destroying your own business.

"A disgruntled customer gave us a libelous review in April 2011. In the summer of 2011, Yelp put the review at the TOP of all the search engines online  "

Are you aware that by posting here, your complaint about Yelp will be put at the top of all search engines?   See how that works?

Their practices are in violation of The US Constitution: First Amendment Free Speech and Yelp is violating my civil rights.  "

Wow.    I can tell by the sentence above that you have neither read the U.S. Constitution, nor the First Amendment.   This does not lend credibility to your case.

I have repeatedly called/written to them to remove any and all of my ads/my companies from their Data Base. I want no part of them or their site. Surely that is my civil right.  "

And it only gets better!  Please enlighten us as to the source of this particular "civil right".  Do you make this stuff up as you go along?

"My Desired Resolution: Withdraw the libelous review. Remove any and all of my ads/my companies from their Data Base. Allow any company nationwide to withdraw their advertising from Yelp. "

What I find particularly comical (and ironic) is that you have posted this complaint on Ripoff Report, where reviews post high on Google searches and CANNOT be removed?   Yet, you appear to think such a thing is wrong and unconstitutional.  That's classic!

Seriously, you have legal remedies for libelous statements about you on the Internet.    They do not involve Attorneys General, the ACLU, or the FTC.  Your belief that your "case" is being handled by any of these organizations will prove disappointing.
