My husband and I refinanced with Ameriquest. We originally asked for a 30 year fixed rate. we originally had a 30 year fixed 6% rate mortgage through wamu. Unfortunatley we had both been out of work due to medical reasons for several months and needed to refinance.

Ameriquest promised to give us a mortgage with our taxes, and homeowners insurance included. They LIED, we didn't find out until months later when we got the bills in the mail.

They also offered us a 30 VARIABLE rate 7% mortgage. When we explained that we ONLY wanted a 30 fixed, Ameriquest PROMISED us that we could refinance in a few months with them and they would be able to give us a 30 fixed rate of 5.5%. That was the only reason we took the mortgage. They told us that they were their own bank, and that they made up their own interest rate and could give us the 5.5% rate GUARANTEED!

When we tried to refinance with them, they stated that the could not refinance our mortgage. They LIED! My husband and I are now faceing intrest rates of 9%, have to pay our taxes and homeowners insurance seperatly.

I am very intersted in being contacted by anyone who has had a similar experience, and also by any lawyer willing to sue the pants of of these LIERS!

First and foremost - why the hell did you sign something if it wasn't what you were promissed. I've said it before and I'll say it again...WALK AWAY if it's not what you were promissed. These guys are CON ARTISTS plain and simple. They find a sucker and gain your confidence...then before you know it your up SH* creek. Anyway...they were supposed to legally provide you disclosures 24 hours prior to a closing if anything changed. Bet they didn't. Go to the NY State banking commission and file a complaint. Their # is 212-618-6553 or 800-522-3330. They violated RESPA laws if you weren't given them 24 hours prior to close with the switch in terms...those papers provide for proper disclosure of fees, rates, terms, etc.... You are likely entitled to fee reimbursement and payback of overcharges and differences from what you were quoted...and you'd better get a good attorney to help you that knows mortgages...don't just go with the shlub on the cover of the yellow pages. They got kicked out of Connecticut for a reason and are being sued in 26+ states...have plead guilty to fraud in a number of cases nationwide...and counting. Now next time take a GOOD LOOK at your credit and if you're late on your mortgage, not 650 FICO or above by a good margin...you're NOT going to get 5.5%...period...end of story...quit believing everything people tell you and do some research. I work for a reputable direct lender and time and time again quote higher...and my customers end up coming back once they figure out that the other guy was full of nothing but hot air and lies. They hook you and get you committed and back you into a corner you think you have no way out of. If that fails...file a civil suit or small claim against them and tell ask local TV station and paper to attend the trial...and then file a criminal case if that doesn't work. They don't show up and they lose by default. Otherwise, stand in front of their office on a public walkway with a sandwich board sign on saying "I GOT RIPPED OFF HERE"....make sure you talk to anyone entering their office or exiting. Find out who they use as closing companies (title companies) and stand outside that office too...and give your story to anyone who comes in to close on an Ameriquest loan. That'll rattle them. I did that with a car dealer...boy did they start cooperating once they figured out I can't be kicked off a public sidewalk. Bring a book and make sure if a cop shows up that you are just "reading" and need good sunlight---and that it happened to be the best spot you could find...so you won't get it for loitering. They may try to ask you to leave...but you have the right to be in a public place as long as you aren't threatening someone. Good luck...go get these rats before the proliferate any more.

Maryanne I have been in the mortgage lending business for more than 7 years now. I have seen way too many lenders tell the consumer one thing, but deliver another. What your describing is the "bait and switch".Im not sure if you applied on-line or elsewhere, but Ill guess you did this on-line, or called in for a quote. The best offer was the 5.5%, so you accepted the offer and beleived that, at close, this would be what you signed up for? A fair warning for anyone who's reading this, and take MaryAnness direction! Do not take the "BEST" offer thats quoted. A majority of the time, the "Fixed Rate" programs are fixed for 2 to 3 years, which means you will refinance in 2-3 years with no guarantees on savings or rate reduction. Thank You,
