In 2010, I had been unemployed and answered an ad for advertising sales local to Victoria. I applied and ended up meeting the President and founder, Patricia Jones. After discussing the program and her products, I was shown the storage facility where I was to also pick up her old advertising booklets and deliver them to the locations I would be looking to sign back up. I did this diligently and actually paid out $242 for printing services for her collateral, contracts and brochures that she wanted me to distribute. Patricia is located in Squamish and therefore asked that I pick up the tab and when she paid me at the end of the month, she would also pay this out. I trusted her to keep her word.

Fast track 2 months later and I still had not received a dime. I had closed a few of the sales without her and she had helped negotiate a few with offers of in kind. One was a sushi place that advertised in the magazine and would provide each of us with $250 in free meals when we ate there. I never took advantage of this as my concern was about the money.

Halfway through the 3rd month, I decided that I needed to get paid. This was never paid and when I questioned Patricia, she indicated that she could not do a separate cheque run but would at the end of the month. Day in and day out for 3 months, I trudged around Victoria trying to obtain business for he magazine. At the end of the 3 months I could not afford to do this anymore since she had still not paid me a dime. At this time, I had to get some funds to support my family and had to resign. Because I resigned, patricia refused to pay me indicating that I had broken the contract and therefore cost her almost all of her advertising money and I was lucky I was not going to be sued by her. I told her that was ridiculous and expected not only to be paid for my sales to date, but also be reimbursed for my cash outlay of her advertising materials. I never charged her for the gas I used to get around town and to the storage facility to gather her outdated magazines.

To this day, Patricia has not paid me a dime nor has she ever reimbursed me for my expenses. I believe this woman lies and is underhanded in her business dealings and lacks integrity. Be aware of Kiss Media Group and get paid upfront!

This libellous report was filed by Mr. David Hendricks against Kiss Media Group Ltd. and Patricia Jones. The laws of British Columbia, Canada require that a lawsuit be filed within two years from the date of publishing the remarks. Unfortunately, this date has now past and I am not able to seek remedies through the courts of British Columbia on this matter.

Kiss Media Group Ltd has been in business since 2000 and is a leading provider of Tourism Publications in Western Canada. We produce mini brochures, visitor maps of Banff, Canmore, and Whistler, a dining guide of Greater Victoria (TASTE MAG), and an online tourism directory (visitormaps.ca). Our team consists of professional and talented graphic designers, writers, distribution managers, sales staff and production coordinators. Our publications are distributed to a network of over 1000 businesses that support our team and our products. Our reputation is very important to us.

Kiss Media Group contracts professional independent sales representatives, graphic designers, and distribution providers. Each relationship is governed by an Agent Agreement or Supplier Agreement that sets out the responsibilities of the Company and the Independent business/business person. Mr. Hendricks was contracted as a Commission-based Sales Agent in the Greater Victoria region for Kiss Media Group Ltd mid July 2010. This was a 90 day contract. As part of David’s sales training, he visited all of our distribution locations and topped up their supply of guides. We find that it is important our sales reps have intimate knowledge of our company’s ad production and distribution process in order to better service our clients.

During the month of August after completing training, Mr. Hendricks continually failed to submit his weekly Sales Report and his Daily Sales Logs. After 3 weeks of failing to submit his reports, Mr. Hendricks was put on notice and not allowed to enter the sales field until his reports were filed with our office. He then submitted one Daily Report Sheet spanning the activities of 3 weeks in the field! This log detailed approximately 35 sales calls only. Over the next week Mr. Hendricks was personally supervised by me daily via telephone to offer sales support. It came to light that Mr. Hendricks was not performing his sales duties and cited family problems and family pressure as the reason. He informed me that he needed to terminate the contract early (5 weeks into the contract) to deal with his teenage son and to look for full-time salaried employment. I then personally assumed his abandoned respsonsibilities.

In October 2010, over 6 weeks after Mr. Hendricks had terminated his contract, he and his wife emailed and called my office seeking payment for commission on one incomplete sale and one undocumented expense. At first I told him to submit and invoice and receipts and reminding him of our cheque run schedule. After reviewing all of the details, I told David that I disagreed with what he was seeking and suggested we enter mediation through the Small Claims Court of BC, as this was the dispute resolution mechanism set out in our contract. I never heard from David Hendricks again. He then posted this very libellous and inaccurate report on this website almost 2 years later.
