My Mother and I returned the vehicle some 3 - 4 years ago. I asked for a copy of the bill of sale. When they called to see that I would pay the difference on the sale, I asked them to send me a copy of the bill of sale. they never did. I have not heard from then since, until yesterday 1-6-07. From a place called Synergetic Communication, Inc.

I received a letter from them stating that our account was placed with them showing the client number and their account number.

Also, stating that income tax season is approciating and that I could use my refund to pay on some of this. On the letter they suggest that I call them regarding payment of this accout.

Texas civil practice & remedies code provide a 4 year limitations for a types of debt. the sol begains the day after the cause of action accrues. section 16.004(a)(3) there's two way to look at this, when they started calling you about the final payment that wasn't made, then, that's when the breech started or the day after you gave the vehicle back. I'm not sure which would apply. the reason there getting on you now is either the sol are close, or just expried but, if you gave the truck back in 2001 , this being 2007 I say there out of luck Becareful, they will try to trick you, to reset the sol, stay off the phone with them, do everything via U.S. Mail. read some of the post here and you'll get alot of imformation on how to deal with them and what to avoid again, I would look up the laws and codes myself, so you get a understanding of what they are you should start now, in case you get a summons, you can be ready and if you do get a summons, answer it and follow the rules of your state court, cause if you don't, even if this is pass the sol, a defualt judgement will be entered against you, and that's what most collection agencys and attorney's want. They count on us, not knowing the laws and are rights There a Tom, form texas that posts on here sometimes, his information is great and Steve from Florida, has good advise on how to deal with collection agency remember nothing here can replace, talking to an attorney in your state again good luck

Your right, it says at the top of the contract,"THIS IS NOT A LEASE". It does say pay so much a month the last payment is So much money. So why are they trying to get me to pay money after 4 years of doing nothing?

After i made my last post to you, i looked up(google) vehicle lease contract and agreements you should look this up and compare this to your contract, it might help. another way to see if you have a lease vehicle, is insurance for lease vehicles have to be much higher then normal, also something on excessve ware and tear and maximun average annual mileage you're allowed without paying a penalty. if these are not in your contract then your vehicle was not leased. again good luck

If you still have a contract on hand, read all the small print and make sure they didn't slip in the lease somewhere. you should contact a legal aid in your city, it sounds like the wrong paper work was sent to this collection agency demand vaidation, have them sent you a copy of the original contract you signed, a complete account history, compare what they send you to what you have Don't sign anything and send everything by mail(RRR) and don't have any phone conversations with them, do everything in writing, via mail it must be spelled out in your contract, that it was a leased vehicle and what a final payment is. if your contract states, all the are payments the same for each month (48 payments X 300.00 a month) then its not a lease. if it has ( 47 payments X 300.00 a month and final payment ??? then it was a lease or words to that effect if you got the contract and it doesn't have a lease options, or where you put the down payment, some where near there it should say security deposit of some amount, Don't agree to any payments or anything. the date you gave the vehicle back starts the clock for the statute of limitation. and it look like it 4 years on a written contract in Tx. as i stated in my first post I'm not an attorney, sometime paying an attorney 50.00 to look over your contract, might not be a bad thing, that way you can put your mind at rest on what your dealing with, sorry i couldn't be of more help, i don't want to give you the wrong or incomplete information and this cause you harm let us know what you find out and good luck

They neither gave me notice or sent me anything for the sale of my 2001 Dodge truck. I purchased it outright, after paying on it for 4 years, they then said that I had a baloon note of $10,000.00 more. It wasn't on my contract, and then they said that I had leased it, I didn't do that either. Kept harrassing me until I gave it back to them, they sold it and then 4 years later they send me this from this other cop,mpany

This is pretty must standard in most states, I'm not a attorney, so just use my advise as a guide to point you in the right direction Car repo are a problem, cause of the dollar amount every scum bag collector see dollar signs Reselling the vehicle: they have 15 day to notify of the sale and they must send you the sale price, what alot of these companies do, is sell the car far below market price, wait a few years to come after you, to add interest and other fee if you default, it has to be in your agreement for them to add interest or fee's during the collection stage once your car has been repossessed, your creditor may decide to keep the car as compensation for you debt or resell it in either a public or private sale. in either case, you creditor MUST notify you about what will happen with the car. If the car is sold at a public auction, you must be notified of the date in advance. if sold at a private sale, you will be notified of a date after it was sold.any resale must be conducted in a COMMERCIALLY REASONABLE MANNER, for example, a resale price which is far below fair market value may be unreasonable. If this occures, you may have a claim against the creditor for damages or a defense against a deficiency judgement If the creditor sat on this collections for a few years, thus running up the interest or other fee's. He has a duty to minimize his damages, See if you can find a copy on the interent for kelly blue book for the year, you gave the car back, this should give you some idea and when they ever, do let you know the sale price, you can see if the sold it low
