Well Fargo Bank is making money by putting levies on your checking account from credit card companies. when they do this they are making your account $0 (zero) so all these overdraft fees will come in for $34 each. I had Wells Fargo do a levy for $ 16.05 and they made $170 from five overdrafts fees. They are making lot of money putting levies of people's checking accounts. they could have least called me and let me know they were going to do it so I could have put the money in the bank to cover my checks that balanced. after they took the money. They didn't offer to credit the overdraft fees either.

The recent response was not intended for Anonymous, Shakopee, Minnesota but for the Employee of Wells Fargo, signed "WithinWells The Hills USA".  My apologies to you Anonymous for my oversight.  My anger toward this company had the better of me and I can understand your frustration with them.  They will continue to rip off consumers until regulations are put in place.

Wells Fargo Bank Unlawful Levy of Account

This is for you Anonymous shakopee, Minnesota.  Rudeness and a belittling personality is a prerequisite to work at this bank!

Wells Fargo Bank levied my account for $1200, returned my payment to the electric company causing me to have to pay with cash only, charged me an NSF fee of $ 70 for returning the electric payment and a $100 bank fee for the levy processing, resulting in a -$35 in my account.

It gets better.... this account is a social security benefit account for a disabled individual.  They (WF) refuse to take responsibility for their error, although they held on to or had posession of the monies for nearly 60 days, disregarding demands for payment by the Sheriffs Dept.  Wouldn't you call this illegal "Miss Anonymous shakopee from Minnesota? or should I call you a "Puppet on a String"?  That is what you amount to within that conglomerate.  Your rebuttal only concludes your supidity is at the same level as the rest of those employed in Wells Fargo's legal department (based in AZ).

During the last 60 days, I have called Wells Fargo Legal Dept. over 45 times, each conversation documented, and have managed to speak with 7 different individuals. No two in the same day when I have had to call and get the unfortunate run around, humiliation, desensitized and dehumanized by the belittling nature of the legal depatment.  I conclude and concur, there is not a single associate employed there with an ounce of empathy for the less fortunate and those on fixed incomes.  Although, I have found they pride themselves on their ability to be rude and fast to respond by terminating the phone call when challenged on procedures, policies, and the law.  Their rebuttal "It's not my position to have to recite or supply information on the laws or WF policies used in the levy process."   The seven individuals that I had the pleasure of speaking with are Chris, Christine, Fatima, Laura, Joseph, and Kay, Cheri'.  All of which will not give out their last names or badge no. nor let me speak with their supervisor.  Christine stated they did not have a Supervisor or Manager.  She must have thought I was stupid.  THe managers name is Mellissa.  She falls into the category of "non-responsive or phantom personnel".  I'm still waiting, after 60 days, for her return call, after my conversation with Christine.

I have made it my number one priorty to call them everyday for a status update, to remind them I am still waiting for my money, and mostly of their illegal and unlawful levying of the bank account, outlined in Section 207 [42 USC 407] which makes this illegal under federal regulations.   I believe Federal regulations pre-empts the state here.

I have now filed complaints with the FTC and the Comptroller of Currency in CA for the unlawful levy on the account and the extreme hardship imposed as these were monies for everyday living expenses.   In addition, I sent daily emails to the CEO and Executives at Wells Fargo to remind them of consumer rights and the adverse action that will be taken against them and those involved in this matter.

In short, a Total Release of the Levy was sent and filed by the judgment creditor after I sent copies of my bank statement showing the social security benefits deposited in the account, which Wells Fargo refused to acknowledge.  They also refused to accept the faxed copyof the Total Release quashing the judgment in full.  They said it was "their policy" to accept the Release of Judgment" only from the Sheriffs Dept, which was received by them on 11/5/2009.  The Sheriffs Dept. rushed it through processing to speed up the release of the funds back to me.

This bank employs degrading and deceptive personnel, who base their decisions on company policy and cannot even recite or obtain the information requested on the procedures used in administering a levy.  They are degenerates working for a bank that has become too large and is run by deceptive individuals who live the luxary lifestyles and put the customers into the streets.  The will never take the blame for their actions

Wells Fargo Bank refused requests and demands for the levied funds by the Sheriff. That is until they received the "Total Release" of the bank levy on 11/5/2009 and immediately cut a cashiers check to the sheriff's dept.  Again making me wait another 7 days and further delay in retrieving the monies that are rightfully due to me.

They allowed this to become personal and I now have taken this on personal level and will take all measures allowable under law,  If you believe in Karma, you should think twice about your actions.  What comes around goes around and you may somneday find yourself in the same predicament or worse.  Except next time, I might be on the other end of the phone when you call for help.  Don't expect any from me.

Levy's are legal and so are the fees that are charged

do you really think it's possible for Wells to call each and every customer they receive a legal order on when they can receive anywhere from 300 to 5000 per day? you probably should have resolved this prior to the credit card company receiving a judgement against you. They charge fee to pay the salaries of the people that have to process the legal orders, they don't work for free.. and as for the od fees again... you should have taken care of the judgment on your own.
