In August 2005 I purchased a vehicle financed through Citi Financial Auto. I have been making payments on a regular basis. But in November of 2005, I called th company to tell them that I would be selling the vehicle because I was moving, and I would have to start over looking for work.

I told the rep that I did not want to fall behind on my payments, so I would either try to sell it or give it back. The rep stated that he would give me a two month deferrment until January 2006. By then he said that I would know what I wanted to do. So I kept the car,and started back making payment out of my income tax refund.

After I moved and got settled in, I found a job, and reported to them that I was working. One thing led to another and in March I fell behind. My son had gotten ill, and I had to stay out of work, amongst numerous things.

I contacted Citi Financial, and agreed to do a check by phone on March 31st, 2006 and April 28th, 2006 to catch up and stay caught up. Well, the payment was drafted out of my account on March 31st as planned. But in April, they drafted my account on the 18th instead of the 28th. I was furious, because I did not have that much money in my account.

Then they proceeded to try to draft two more times. I had to pay back the bank in overdraft fees, which meant I could not pay them the full amount. I contacted my bank and set up a meeting with an account rep. She and I called a Citi Financial rep on speakerphone. My bank rep stated that if they (citi financial) did not have a voice record or paper documentation, then they could not draft my account early.

The Citifinancial rep hung up. On April 28th, I received a call from a Citi Financial rep, and they wanted a payment. I said that I cannot send in a full payment because I had to pay overdraft fees because of an unauthorized draft by the company. The rep was very nasty to me, she said I needed to send the payment in by April 29th before 7pm. I told her that the best I could do was to pay May 5th. She told me to call back on Monday or Tuesday.

I called back on Monday May 1, 2006 and they now stated that I needed to pay $820 by May 5th to keep my vehicle. I said let me see what I can do,and I will call back on Tuesday. I called back Tuesday, and stated that I had $500 now and could do the rest on the 26th. The Citi Financial rep stated that she could accept the $500 now and the $320 later if I do a check by phone.

I said oh, no not again. Then she stated that I would need to pay the entire amount by Friday ($820), because she could only secure it with a bank draft. So now I am stuck about what to do. I am trying to offer money, but they won't accept it unless I authorize another bank draft,and I cannot afford to lose my car. What should I do?

I have resolved my issue with the bank. I have made previous arrangements and can afford the vehicle which I so dearly love.
