Nicolas, First, I can understand your frustration in this situation. However, you DO have rights and you can get those erroneous reports removed and you actually have cause for a lawsuit. The DAC report is regulated under the Fair Credit Reporting Act just like a credit report. This means you have the right to dispute any information on that report and have it removed, and also to add your 100 word or less consumer statement. However, DAC/USIS is VERY difficult to deal with and they use "canned" or "generic" statements that the employer just selects from a drop down menu that rarely offer accurate information. Communicate with them ONLY in writing, and ONLY by certified mail, return reciept requested. Be sure to put the certified# on the letter itself and keep a copy for your records. Also, by the means above, send Werner a copy of the dispute letter, along with an INTENT TO SUE letter, and address it to the legal dept at Werner. This preserves our rights under the law for a slander suit. Good luck!
